License

This agreement is between Tamagui LLC ("we", "us") and you, and governs the Peach software: the simulator engine and runtime, shell, CLI, desktop application, build plugins, and any updates we provide (the "Software"). Cloud services such as shares, previews, and CI uploads are governed separately by our Terms of Service. By using the Software you accept this agreement.

1. Definitions

• "Internal Use" means use by your organization's licensed members for developing and testing your own applications, on machines and CI systems your organization controls.
• "Embedding" means making the Software, or any experience powered by it, available to anyone other than your licensed members: integrating the simulator into a product, website, documentation, or service that third parties can access, or redistributing any part of the Software.
• "Organization" means you and every entity that controls, is controlled by, or is under common control with you.

2. Seed license

We grant individuals and Organizations with fewer than 10 people and less than $1 million in yearly revenue a non-exclusive, non-transferable, revocable license for desktop and local Internal Use, including commercial work and CI use, at no cost. Local simulators, members, agents and API keys are unlimited.

3. Team license

An Organization with 10 or more people or $1 million or more in yearly revenue requires an active Team subscription for Internal Use, including desktop and local use, while it has fewer than 25 people and less than $3 million in yearly revenue. Team is $30 per month or $300 per year, with $10 of cloud usage each month. Members, agents, API keys and local simulators are unlimited. Embedding is not included.

4. Enterprise license

Organizations with 25 or more people or $3 million or more in yearly revenue, and all Embedding or redistribution, require a separate written agreement. Company size and revenue are self-reported and enforced through these terms only, without license keys, seat counts or in-app company-size checks. 5. Restrictions

Except as expressly permitted, you may not:

• Distribute, sublicense, rent, or provide the Software to any third party, or make it available as part of any product or service.
• Modify the Software or create derivative works of it.
• Reverse engineer, decompile, or disassemble the Software, except to the extent applicable law permits despite this limit.
• Remove or alter any proprietary notices.
• Use the Software to build a competing product.

6. Ownership

The Software is licensed, not sold. We and our licensors retain all rights not expressly granted. Feedback you send us may be used without obligation to you.

7. Termination

This agreement terminates automatically if you breach it. The Team grant ends when the subscription ends. On termination you must stop using the Software and delete your copies; sections 5 through 9 survive.

8. Disclaimer

The Software is provided "as is", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, and our total liability under this agreement is limited to the amounts you paid us for the Software in the 12 months before the claim arose.

10. Changes

We may update this agreement for future versions of the Software; the version accompanying your copy governs that copy.
